These Terms of Service (“Terms”) govern your use of the MIAMI BY JOSEPH ALBORNOZ website and your purchase of products and services offered through it.

By accessing this website, creating an account, placing an order, or using any services provided through this website, you agree to these Terms.

1. BRAND IDENTITY

MIAMI BY JOSEPH ALBORNOZ is a distinct and separate brand from any business, designer label, collection, or product operating under the name JOSEPH ALBORNOZ.

Products and benefits offered through this website belong exclusively to MIAMI BY JOSEPH ALBORNOZ, unless expressly stated otherwise.

Any reference in these Terms to “we,” “us,” “our,” or “the Brand” means MIAMI BY JOSEPH ALBORNOZ.

2. PRODUCTS

MIAMI BY JOSEPH ALBORNOZ produces limited-release products and may produce products specifically for individual releases or pre-orders.

Product photographs, colors, textures, embroidery, and other visual representations may vary slightly due to photography, lighting, manufacturing processes, materials, displays, and individual screens.

We reserve the right to limit quantities purchased by a customer.

3. PRICING AND PAYMENT

All prices are displayed in U.S. dollars unless otherwise stated.

Prices may change at any time. Price changes will not affect orders that have already been placed and paid for.

Applicable taxes and shipping charges may be added during checkout.

Payment must be successfully completed before an order is considered accepted for fulfillment.

4. ORDERS

You are responsible for providing accurate billing, shipping, contact, and payment information.

We reserve the right to refuse, cancel, or limit an order when reasonably necessary, including because of suspected fraud, unauthorized transactions, inventory errors, pricing errors, or other circumstances affecting the transaction.

If we cancel an order after payment has been collected, any refund required by applicable law will be issued.

5. ALL SALES ARE FINAL

ALL SALES ARE FINAL.

Except where a refund, cancellation, return, replacement, or other remedy is required by applicable law, MIAMI BY JOSEPH ALBORNOZ does not accept returns, exchanges, or customer-requested cancellations after an order has been placed.

We do not provide refunds because a customer:

  • Changes their mind
  • No longer wants the product
  • Orders the wrong product
  • Orders the wrong size
  • Dislikes the color or appearance
  • Decides they no longer want the product
  • Finds the product different from their personal expectations

Customers are responsible for reviewing product descriptions, sizing information, product details, shipping information, and other applicable information before completing checkout.

Nothing in this section limits rights that cannot legally be waived.

6. DAMAGED, DEFECTIVE, OR INCORRECT PRODUCTS

We may request photographs, your order number, and other information necessary to evaluate the issue.

If a product qualifies for a remedy under applicable law or our policies, we may provide an appropriate replacement or other legally required remedy.

7. PRE-ORDERS

Pre-order products are produced specifically for the applicable release and may not be immediately available for shipment.

The estimated shipping timeframe will be displayed on the applicable product page before purchase.

If a product states that it is expected to ship within 4–5 weeks of purchase, that estimate represents our expected fulfillment timeframe based on the information available when the order is accepted.

If we cannot ship an order within a timeframe required by applicable law, we will provide any legally required notice and cancellation or refund options.

8. BELIEVER TICKET

Certain products may include a Believer Ticket.

The Believer Ticket is a promotional benefit issued by MIAMI BY JOSEPH ALBORNOZ to recognize customers who supported the movement at an early stage.

A valid Believer Ticket:

  • Is non-transferable
  • Does not expire
  • May be redeemed for one future product released under MIAMI BY JOSEPH ALBORNOZ
  • May only be redeemed once
  • Has no cash value
  • Cannot be exchanged for cash

The Believer Ticket applies exclusively to products released under the MIAMI BY JOSEPH ALBORNOZ brand.

The Believer Ticket does not apply to products, collections, or designs released under the separate JOSEPH ALBORNOZ brand.

Additional redemption requirements are provided in the Believer Ticket Terms.

9. SMS / RCS MESSAGING TERMS

MIAMI BY JOSEPH ALBORNOZ SMS/RCS Messaging Program

By opting in to receive text messages from MIAMI BY JOSEPH ALBORNOZ, you agree to receive recurring automated promotional and personalized marketing text messages from MIAMI BY JOSEPH ALBORNOZ at the mobile telephone number provided.

Message frequency varies. Message and data rates may apply.

Messages may include information regarding product releases, pre-orders, promotions, discounts, restocks, events, and other marketing communications from MIAMI BY JOSEPH ALBORNOZ.

Reply STOP to unsubscribe. Reply HELP for assistance.

Consent to receive marketing text messages is not a condition of purchase.

Your consent applies specifically to the MIAMI BY JOSEPH ALBORNOZ SMS/RCS Messaging Program and is not a condition of purchasing any product.
